Misconception of Ijarah Multijasa

Ijarah Multijasa was introduced as banking product as early as 2004 when an Islamic Banking Unit of a conventional bank received an approval from National Sharia Board (Dewan Syariah Nasional-DSN) - the Indonesian Council of Ulama (Majelis Ulama Indonesia -MUI).
Ijarah Multijasa was originally developed from  demand for 3 kinds of financing; religious tour, education and wedding ceremony. Later it includes health financing and manpower as well.



Original concept in Islam: Free Education and Free health services
Muslims in classical tradition never pay for education. Even after they develop high level education such as universities and expert forum. The students are selected according to their merit, while the teachers are paid by the government or they have their own business to support their life. However, Western education introduce commercial aspect of education so that the muslims have to support their own education for their chhildren. 

Misconception in Scheme
The ideal for Ijarah Multijasa would be there is a working relationship between Islamic Financial Institution and service provider, such as hospital, schools, travel bureau and so on, so that the scheme advised by National Sharia Board work properly. Customer deal with IFI and IFI deal with the service provider. 

Misconception in object of financing
Object of financing in Ijarah Multijasa are the one which are provided by government free of charge, such as education, health,

Confusion between kafalah and ijarah
There is another confusion among the IFIs practitioners. It is Ijarah or Kafalah/Hiwalah? Seeing the above discussion on scheme, in fiqh literature it can be categorized as hiwalah (if two debt from different parties are set-off/ netted) and Kafalah (under Hanafi school)
